The undersigned Auction Company has been authorized to sell the real estate belonging to the Estate of Maurice J. Murray, located at 7500 Barter Road in Section 32 of the Northwest part of Marrs Township, Posey County, Indiana.

 

REAL ESTATE: The Real Estate consists of approximately 40 +/- wooded acres containing a fantastic stand of hardwood timber including white, red, and black oak, yellow poplar, ash, and some American walnut. 

 

The property is improved with two (2) houses.  A 1900 constructed 1.5-story wood frame house contains 1,944 sq. ft. and includes (3) bedrooms & (1) bath, a finished attic (576 sq. ft.), and a detached garage measuring 18′ x 14′. 

 

A 1900 constructed 1-story brick house contains 1,596 sq. ft. and includes (3) bedrooms & (1) bath, a partial basement (532 sq. ft.), and a detached garage measuring 30′ x 28′.  This house is a converted schoolhouse.

 

TRACTS:

TRACT 1 – The brick house and 1 acre

TRACT 2 – The frame house and 2 acres

TRACT 3 – 18 acres

TRACT 4 – 20 acres

 

PROCEDURE: The Real Estate will be offered in four (4) individual tracts, combination of tracts, and the entirety.  There will be open bidding on all tracts and the entirety during the auction as determined by the Auctioneer.  Bids on separate tracts, combinations, and the total property may compete.  Conduct of the auction and increments of bidding are at the direction and discretion of the auctioneer.  All decisions of the Auctioneer are final.

 

DOWN PAYMENT: A 10% down payment is due on the day of the auction with the balance due at closing.  The down payment may be in the form of cash, cashier’s check, personal check or corporate check.  Bidding is not conditional upon financing, so be sure to have financing arranged, if needed, and be capable of paying cash at closing.

 

ACCEPTANCE OF BID PRICES: Successful bidder will be required to enter into a Purchase Agreement at the auction immediately following the close of the auction.  All final bid prices are subject to the Seller's acceptance or rejection.

 

BUYER’S PREMIUM: A 7% Buyer’s Premium will be added to the high bid to determine the contract sale price.

 

DEED: Seller shall provide a Personal Representative's Deed conveying title to the property.

 

CLOSING: The balance of the purchase price is due at closing, which will take place within 30 days of presentation of insurable title.

 

POSSESSION: Possession will be at closing.

 

REAL ESTATE TAXES: The real estate taxes will be the responsibility of the Buyer beginning with the taxes due and payable in May 2011 and thereafter.   

 

ACREAGE: All tract acreages, dimensions and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos.  Buyer should make his own independent determination of acreage prior to bidding.

 

SURVEY: If a survey is deemed necessary, the cost of the survey will be shared 50/50 between the Buyer and the Seller.

 

MINERALS:             The Seller will convey all mineral interests they own with the real estate.
